This was recently the case in Harris County, when a man was killed after checking on a dog he hit. The fatal accident happened on the morning of October 20 at 21000 Cypresswood Drive.

The man pulled over after hitting a dog on Cypresswood Drive, near FM 1960, in Humble. He  got out of his car to pull the dog away from the road. As he was doing so, a Chevy Malibu that was heading north hit him. The man died at the accident scene.

The Malibu sustained a shattered windshield and other damage. The driver remained at the accident scene. The Harris County Sheriff’s Office said that the victim was at fault, as he failed to yield the right of way to oncoming traffic.

Failure to Yield

Failure to yield is a common traffic violation. It typically applies to motorists, but pedestrians can also be at fault, as seen in this case. Pedestrians cannot simply enter the roadway at any time, even if they are trying to retrieve something from the road. They have to yield and wait their turn. Vehicles are not obligated to stop for pedestrians unless they are in a crosswalk and waiting their turn.

Failure to yield accidents commonly occur when:

  • There is a flashing yellow or red light.
  • A driver making a left turn fails to yield to oncoming traffic.
  • A car is aggressive about merging onto the highway.
  • A driver is entering the street from a private driveway.
  • A driver fails to yield the right of way to a pedestrian already in a crosswalk.
  • A pedestrian jumps out into the road in front of vehicles without warning.

Whether or not you are at fault for the crash, you should never admit liability. Never apologize to the other party, as that can be seen as an admission of guilt.
