Government Liability for Dangerous Conditions

Liability5

Government agencies are often protected from lawsuits under the legal doctrine of sovereign immunity. However, this protection is not absolute. In many cases, laws allow individuals to bring claims against public entities when negligence leads to injuries or property damage.

One common exception arises when a hazardous condition exists on government-owned or controlled property. If a public agency knew or reasonably should have known about a dangerous condition and failed to correct it or provide adequate warnings, it may be held legally responsible for resulting harm.

Dangerous conditions can include poorly designed or maintained roads, inadequate pedestrian or bicycle infrastructure, obstructed signage, poorly designed intersections, broken pavement, inadequate lighting, or unsafe traffic patterns. If these hazards create an unreasonable risk of injury, they may form the basis of a claim.

These risks are especially concerning as more people rely on walking and biking for transportation, often on roadways originally designed primarily for motor vehicles. Dedicated bike lanes separate cyclists from vehicle traffic, reducing the likelihood of collisions. Studies have shown that protected lanes can significantly lower both accident rates and the severity of injuries when crashes do occur.

The Need for Safer Infrastructure

Walking and biking are becoming more common modes of transportation across the country. However, roadways have not always evolved to safely accommodate this shift. Many streets, especially busy intersections, remain hazardous for anyone outside of a vehicle.

Research consistently shows that building dedicated infrastructure for bicyclists and pedestrians can significantly reduce accidents and fatalities. For example, adding protected bike lanes has been found to dramatically lower the risk of deadly bicycle crashes by as much as 50% in some cases.

As safer infrastructure becomes more available, more people are willing to use it. Studies examining major U.S. cities have found that when protected bike lanes are introduced, cycling rates increase substantially. In some areas, ridership has grown anywhere from 20% to more than 100% after these improvements were made.

Despite growing demand, investment in safe infrastructure often falls short. This gap between public need and government action raises important questions about responsibility. When hazards are known and solutions are available, failing to act could be viewed as negligence.

When public agencies fail to address known safety risks, they may be exposing themselves to legal liability. Roads that lack proper design features for pedestrians and cyclists can create dangerous conditions that contribute to preventable injuries and fatalities.

Sometimes drivers are not responsible for car accidents. It is possible that a government entity could be to blame, but the process for filing a claim and obtaining compensation can be very complex. Claims against government agencies typically have shorter deadlines than standard personal injury cases, so having experienced legal help is essential.
