2 Killed In Houston Drunk Driving Accident

Alcohol use is never a good idea before getting behind the wheel of a vehicle. Beer, wine, and liquor can impact the body dramatically, causing slower reaction time, poor judgment, and other issues.

A recent drunk driving accident in Houston has left two people dead. The fatal accident occurred on the evening of February 9 on Bellfort Avenue.

An SUV collided with a forklift in an industrial area. The driver was allegedly drinking before getting behind the wheel. Two passengers in the SUV were killed. The driver and a passenger in the front seat were injured and taken to a local hospital. The driver of the forklift was able to walk away from the crash without any serious injuries.

The forklift operator was performing work duties. The forklift was crossing the road when the crash happened. The SUV had a chance to stop since there was another vehicle that was stopped and waiting for the forklift. However, the SUV was assessed at going 70 miles per hour — double the speed limit of 35 miles per hour.

The driver admitted to drinking alcohol just moments before the crash. Police found open containers inside the SUV.

The impact was due to the weight of the forklift. These heavy-duty vehicles may weigh about 5 tons. It was equivalent to hitting a brick wall, particularly at the speed the SUV was going.

Nobody inside the SUV has been identified yet. The driver could face two counts of intoxication manslaughter as well as one count of intoxication assault. The district attorney’s office is also trying to see where the driver was drinking to determine if the bartender or the establishment could face criminal charges.

Texas Dram Shop Laws

Under Texas’ dram shop laws, a bartender or establishment could be held liable for a drunk driving accident. This dram shop law applies to anyone who sells alcohol. Under this law, alcohol providers can be held liable for damages caused by a customer if:

  • It was apparent to the provider that the customer was intoxicated to the point that they were a clear danger to themselves or others.
  • The intoxication of the customer directly led to the car crash or other type of accident and subsequent damages.

For example, if a bartender continues to serve a customer who is slurring his words and unable to walk steadily, and that person ends up causing a crash, fall, assault, or other altercation, and the victim suffers injuries as a result, then the bar could be held liable.
